Terms and Conditions for Planning Services and Digital Products
1. Scope of Application
These Terms and Conditions govern the contractual relationship between clients (hereafter “Clients”) and Kings and Swans GmbH, the operator of services and products marketed under the Switzerland Insider brand.
These Terms apply to all travel planning services and digital products provided by Kings and Swans GmbH, including travel consultations, custom travel itineraries, digital travel guides, planning resources, and other informational materials related to travel in Switzerland.
By purchasing, accessing, or using any service or product provided by Kings and Swans GmbH, Clients confirm that they accept these Terms and Conditions.
2. Nature of the Services
Kings and Swans GmbH provides travel planning services and informational resources intended to assist travelers in planning trips to Switzerland.
Services may include travel consultations, itinerary recommendations, destination guidance, and other planning support. Kings and Swans GmbH may also offer digital products such as travel guides, planning tools, and other downloadable resources designed to support independent travel planning.
All services provided by Kings and Swans GmbH are advisory in nature. Kings and Swans GmbH does not act as a travel agency and does not make bookings or reservations for accommodations, transportation, restaurants, activities, or other third-party services.
Any bookings or services arranged by Clients are concluded directly between the Client and the respective third-party provider and are subject to the terms and conditions of those providers.
3. Liability
All information, advice, recommendations, guides, itineraries, and other materials provided by Kings and Swans GmbH are intended for informational and/or educational purposes only.
While Kings and Swans GmbH aims to provide accurate and up-to-date information, travel conditions, schedules, prices, and the availability of services may change at any time.
Clients remain solely responsible for their travel decisions, bookings, and activities. Clients are also responsible for verifying important details such as schedules, opening hours, availability of services, and booking conditions before making travel arrangements.
Kings and Swans GmbH shall not be liable for injuries, financial losses, delays, missed reservations, or other inconveniences resulting from the use of its services, digital products, or informational materials.
Kings and Swans GmbH is not responsible for the services, actions, or performance of third-party providers, including but not limited to transportation companies, accommodations, activity operators, or other vendors used by the client.
To the extent permitted by applicable Swiss law, liability for indirect damages, consequential damages, and loss of profit is excluded.
Liability shall in any case be limited to the extent permitted under applicable Swiss law.
4. Prices and Payment
Prices for services and digital products offered by Kings and Swans GmbH are displayed on the respective product or booking pages.
Unless otherwise stated, prices are listed in United States Dollars (USD). Prices may include applicable taxes where required by law.
Payment for services or digital products is typically required at the time of booking or purchase through the payment methods provided on the website.
Kings and Swans GmbH reserves the right to adjust prices at any time for future bookings or purchases. Price changes do not affect orders that have already been confirmed.
Discounts, promotional offers, or bundled pricing may be introduced or withdrawn at any time without prior notice.
5. Communication
Communication between Clients and Kings and Swans GmbH may take place through email, video calls, or other communication channels used to provide the agreed services.
Travel consultations and related interactions may be conducted via online meeting platforms such as Zoom or similar services.
Kings and Swans GmbH reserves the right to discontinue communication or terminate a consultation if interactions become inappropriate, abusive, or otherwise unreasonable.
6. Travel Consultations
Travel consultations are booked through the scheduling system provided by Kings and Swans GmbH. Payment is required at the time of booking, and a consultation is confirmed once the booking has been completed and payment has been successfully processed.
Clients may cancel a consultation up to 24 hours before the scheduled consultation time and receive a full refund. Cancellations made less than 24 hours before the scheduled consultation time are not eligible for a refund.
Clients may reschedule a consultation one time using the rescheduling link provided in the booking confirmation. Rescheduling must be completed at least 24 hours before the scheduled consultation time.
7. Digital Travel Guides
Kings and Swans GmbH offers digital travel guides and similar downloadable resources intended to assist travelers in planning trips to Switzerland.
Travel guides are provided as digital downloads, typically in PDF format. By purchasing a guide, Clients receive a license to use the guide for personal travel planning purposes.
Clients may share the guide with members of their immediate travel group, such as family or travel companions. Redistribution, resale, large-scale sharing, or commercial use of the guides is not permitted.
Kings and Swans GmbH strives to ensure that the information contained in the guides is accurate and up to date. However, travel conditions, schedules, prices, and the availability of attractions or services may change. Clients are responsible for verifying important details before making travel arrangements.
Kings and Swans GmbH may update travel guides from time to time. Clients who have purchased a guide may request the most recent version by contacting Kings and Swans GmbH and providing proof of purchase.
Refunds for digital travel guides are available within 30 days of purchase. Kings and Swans GmbH reserves the right to refuse refunds or future services in cases of repeated refund requests or evidence of misuse, including redistribution or resale of the guide.
7. Custom Itineraries
Kings and Swans GmbH may offer custom travel itineraries tailored to the preferences and travel plans of individual clients.
Custom itineraries are created based on the information provided by the client and are intended to assist with planning a trip to Switzerland. The itinerary reflects recommendations and planning suggestions prepared specifically for the client.
Custom itineraries are provided for the client’s personal use. Clients may share the itinerary with members of their travel group, such as family members or travel companions. Redistribution, resale, or public sharing beyond this purpose is not permitted.
One round of adjustments to the itinerary may be requested within seven (7) days after delivery of the itinerary. Additional revisions or significant changes beyond the original scope may require a new agreement or additional fees.
Payment for custom itineraries becomes due after the completed itinerary has been delivered to the client. If no feedback or adjustment request is received within seven (7) days of delivery, the itinerary will be considered accepted and payment will become due.
8. Free Resources
Kings and Swans GmbH may provide free resources intended to assist travelers in planning a trip to Switzerland. These resources may include downloadable materials, planning tools, guides, or other informational content.
Free resources are provided to offer general guidance and insights for travel planning. They may be updated, modified, or discontinued at any time without notice.
All materials provided as part of free resources remain the intellectual property of Kings and Swans GmbH and may not be redistributed, resold, or publicly shared without prior written permission.
9. Newsletter
Kings and Swans GmbH may offer a newsletter containing travel insights, planning tips, updates, and occasional promotional offers related to travel in Switzerland.
Subscribers may unsubscribe from the newsletter at any time using the unsubscribe link included in each email.
Kings and Swans GmbH reserves the right to modify, suspend, or discontinue the newsletter at any time.
10. Public Content and Social Media
Kings and Swans GmbH may publish travel-related content on websites, social media platforms, video platforms, and other public channels under the Switzerland Insider brand.
This content may include travel explanations, recommendations, planning tips, and general information about traveling in Switzerland.
Public content is provided for general informational and educational purposes and reflects the knowledge, research, and experience of Kings and Swans GmbH at the time of publication.
Travel conditions, schedules, prices, and availability of services may change at any time. Users remain responsible for verifying important details before making travel decisions.
All content published by Kings and Swans GmbH, including text, images, graphics, and videos, remains the intellectual property of the company unless otherwise stated and may not be reproduced, redistributed, or used for commercial purposes without prior written permission.
11. Intellectual Property
All materials, guides, itineraries, resources, and content provided by Kings and Swans GmbH, including digital downloads, written materials, images, graphics, videos, and other media, remain the intellectual property of the company unless otherwise stated.
Clients and users may use these materials for personal purposes only unless explicitly permitted otherwise.
Redistribution, resale, large-scale sharing, or commercial use of these materials without prior written permission from Kings and Swans GmbH is prohibited.
12. Dispute Resolution and Applicable Law
If any issues arise, clients are encouraged to contact Kings and Swans GmbH directly in order to resolve the matter amicably.
These Terms and Conditions and the contractual relationship between the client and Kings and Swans GmbH shall be governed by Swiss law.
To the extent permitted by applicable law, the courts of Lucerne, Switzerland shall have exclusive jurisdiction over any disputes arising from or in connection with these Terms and Conditions.
13. Salvatory Clause
Should any provision of these Terms and Conditions be or become invalid or unenforceable, the validity of the remaining provisions shall not be affected.
The invalid provision shall be replaced by a valid provision that most closely reflects the intent and economic effect of the original provision.

Terms and Conditions for Tours
1. Scope of Application
These Terms and Conditions govern the contractual relationship between participants (hereafter “Participants”) and Kings and Swans GmbH, the operator of tours marketed under the Switzerland Insider brand.
These terms apply to all guided tours and related experiences offered by Kings and Swans GmbH, including both public tours and private tours. Tours may take place in urban environments, rural areas, or mountain regions and may include walking through cities, villages, natural landscapes, and viewpoints.
Some tours may include hiking sections on officially marked Swiss hiking trails up to difficulty level T1–T3 according to the Swiss Alpine Club hiking scale. These trails may include natural terrain such as gravel paths, dirt trails, uneven ground, or potentially slippery surfaces. Tours remain on marked hiking trails and do not include alpine terrain or routes requiring mountain-guide qualifications.
During tours participants may encounter lakes, viewpoints, or recreational attractions. Participants may choose to swim or use such attractions on their own initiative. These activities are voluntary and take place at the participant’s own responsibility.
By booking or participating in a tour, Participants confirm that they accept these Terms and Conditions.
2. Booking and Contract Formation
Tour bookings can be made through the official website of Switzerland Insider, through authorized booking platforms, or through other channels approved by Kings and Swans GmbH.
A contract between the Participant and Kings and Swans GmbH is concluded once a booking has been confirmed and the required payment has been successfully completed.
Participants are responsible for providing accurate contact information when making a booking.
If a booking is made by one person on behalf of additional participants, the person making the booking confirms that all participants accept these Tour Terms and Conditions.
Kings and Swans GmbH reserves the right to decline or cancel bookings in exceptional circumstances.
3. Prices and Payment
All tour prices are stated in Swiss francs (CHF) unless otherwise specified.
The applicable price is the price displayed at the time of booking.
Payment is generally required at the time of booking through the booking system or another payment method provided by Kings and Swans GmbH. A booking is considered confirmed only after the required payment has been successfully completed.
All prices include applicable Swiss value-added tax (VAT) where required by law.
Kings and Swans GmbH reserves the right to change prices at any time for future bookings. Price changes do not affect bookings that have already been confirmed.
4. Cancellation by Participants
Participants may cancel their booking at any time by notifying Kings and Swans GmbH in writing, including by email.
Unless otherwise stated at the time of booking, the following cancellation policy applies:

More than 24 hours before the scheduled start time of the tour: full refund

Less than 24 hours before the scheduled start time: no refund
Participants may request to reschedule their booking instead of cancelling, subject to availability.
Refunds will generally be issued using the original payment method whenever possible.
5. Cancellation or Changes by the Operator
Kings and Swans GmbH reserves the right to cancel or modify a tour if circumstances make the tour impossible, unsafe, or significantly hindered.
Such circumstances may include, but are not limited to:

severe weather conditions

safety concerns
-
force majeure events
-
unforeseen operational circumstances
If a tour is cancelled by Kings and Swans GmbH, participants will be offered either:

a full refund, or
-
the possibility to rebook on another available date.
Public tours require a minimum number of five (5) paying participants. If the minimum number is not reached, Kings and Swans GmbH reserves the right to cancel the tour. Participants will be informed at least 24 hours before the scheduled start time whenever possible and will be offered either a refund or the option to rebook on another available date. This minimum participant requirement does not apply to private tours.
6. Participation Requirements
Participants are responsible for ensuring that they are physically able to take part in the tour they have booked.
Tours may involve walking for extended periods and may take place in urban areas, rural environments, or on official hiking trails. Depending on the route, terrain may include natural surfaces such as gravel paths, dirt trails, uneven ground, or potentially slippery sections.
Participants are responsible for wearing appropriate clothing and footwear suitable for the weather and terrain conditions.
Participants must follow the instructions of the guide during the tour and behave in a manner that does not endanger themselves or others or significantly disrupt the experience for other participants.
Kings and Swans GmbH reserves the right to exclude participants from a tour if their behavior poses a safety risk or significantly interferes with the tour. In such cases no refund will be provided.
Children may participate in tours only when accompanied and supervised by a responsible adult.
7. Third-Party Services and Attractions
During a tour, participants may encounter services or attractions provided by independent third parties. These may include, for example, transportation providers, recreational attractions, restaurants, or other facilities.
Participation in such activities or the use of such services is voluntary. Any contract for these services is concluded directly between the participant and the respective third-party provider.
Kings and Swans GmbH does not operate or control these services and is not responsible for their availability, safety, operation, or performance. The terms and conditions of the respective third-party provider apply.
8. Late Arrival and No-Show
Participants are responsible for arriving at the designated meeting point on time.
Tours start at the scheduled time. If a participant arrives late, the tour may have already started and it may not be possible to join the group.
Guides may wait briefly at the meeting point but are not required to delay the start of the tour.
Participants who fail to attend the tour or arrive too late to join are considered no-shows and are not entitled to a refund.
9. Liability
Participation in tours operated by Kings and Swans GmbH is voluntary and takes place at the participant’s own responsibility.
Participants acknowledge that tours take place in public environments such as cities, villages, natural landscapes, or mountain areas and may involve typical conditions associated with outdoor activities.
Participants are responsible for ensuring that their health and physical condition allow them to participate safely and for acting prudently during the tour.
Participants must follow the instructions of the guide and comply with applicable laws and safety rules.
Participants are responsible for their personal belongings during the tour.
Participants are responsible for maintaining appropriate personal insurance coverage, including health, accident, and liability insurance where applicable.
Kings and Swans GmbH shall not be liable for injuries, accidents, losses, delays, or other inconveniences that may occur during the tour except where liability cannot be excluded under applicable law.
Kings and Swans GmbH shall not be liable for damages caused by circumstances outside its control, including but not limited to weather conditions, actions of other participants, actions of third parties, or other unforeseen events.
10. Data Protection
Personal data collected during the booking process is processed by Kings and Swans GmbH for the purpose of organizing and conducting the tour.
The handling of personal data is governed by the Privacy Policy of Kings and Swans GmbH, which forms an integral part of these terms.
Participants acknowledge that their contact information may be used for communication related to their booking.
11. Dispute Resolution and Applicable Law
Should any issues arise, participants are encouraged to contact Kings and Swans GmbH directly in order to resolve the matter amicably.
These Tour Terms and Conditions and the contractual relationship between the participants and Kings and Swans GmbH shall be governed by Swiss law.
To the extent permitted by applicable law, the courts of Lucerne, Switzerland shall have exclusive jurisdiction over any disputes arising from or in connection with these Tour Terms and Conditions.
12. Salvatory Clause
